Oh Snap Smiles terms and condition
Service Details
Event price includes: Delivery, setup and teardown of booth and optional online photo gallery (for 3 weeks) with free, unlimited photo downloads; unlimited single prints; and standard prop selection (if included).
Photo Booth Operations
Oh Snap Smiles agrees to have the photo booth operational for the time period specified; however, in some situations operations may need to be interrupted for maintenance, service, and/or photography optimizations. Oh Snap Smiles agrees to send a qualified technician on site to maintain and operate the photo booth. Client agrees that Oh Snap Smiles will not be responsible for consequential damages. If only partial services can be provided due to conditions beyond our reasonable control, then half of rental charges shall be issued as a proÂrated credit on a future booking date and the other half remains non refundable.
SETUP AND TEARDOWN TIME
Oh Snap Smiles will deliver, setup, and remove the photo booth from the event location. Operation of photo booth times may be adjusted if event location or client ends the event prior to the contracted end time and no refund or money will apply.
SET UP SPACE AND POWER
Our photo booths need two things to run well  Space and Power. 8ft x 8ft. All photo booths are powered by 110V, 10 amps, 3 prong standard electrical outlets that are preferably within 25 feet of the designated setup area.
LIABILITY AND INDEMNIFICATION
Oh Snap Smiles agrees to carry general liability insurance. Oh Snap Smiles shall not be liable under any contract for direct, indirect, incidental or consequential damages (including without limitation, damages for lost profits or increased expenses) with respect to any claim arising from or related in any way to this agreement and services provided. The Client will indemnify and hold harmless Oh Snap Smiles against any and all liability related to Clients Event from the time of service and on into the future. Client will assume all legal fees claimed by third persons, provided such loss or damage was not caused by the fault or negligence of Oh Snap Smiles or its employees, agent, or subcontractors. Client acknowledges that it shall be responsible for any damage or loss to the Oh Snap Smiles.
DAMAGE TO EQUIPMENT
Houston equipment caused by:
a) Any misuse of the equipment by Client or its guests, or
b) Any theft or disaster (including but not limited to fire or water damage). Damages to be determined by management based on nature and severity of damage.
MODEL RELEASE
All guests using the photo booth hereby grant Oh Snap Smiles: The right and permission to copyright and use, photographic portraits or pictures of any photo booth user who may be included intact or in part, made through any and all media now or hereafter known for illustration, art, promotion, advertising, trade, or any other purpose. In addition the Client does hereby release, discharge and agree to save harmless Oh Snap Smiles from any liability that may occur or be produced in the taking of said picture or in any subsequent processing thereof, as well as any publication thereof, including without limitation any claims for libel or invasion of privacy. If any provision of these terms shall be unlawful, void, or for any reason unenforceable under Contract Law, then the provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof. In the event of a conflict between parties, the Client agrees to solve any arguments via arbitration. This agreement constitutes the entire agreement and supersedes all prior oral, written, and other agreements between the parties with respect to the subject matter hereof. This agreement may only be amended in writing by Oh Snap Smiles and Client.
SERVICE RETAINER
A service retainer in the amount of 50% of the contract price is required at the time of signing this agreement. The preferred method of payment is a major credit card or debit card (Visa, MasterCard, or American Express). The Service Retainer is nonÂrefundable, but is transferable to a new available date. In this case, Oh Snap Smiles requires both parties enter into a new agreement one month in advance.
BALANCE DUE
Balance is due 15 days prior to the contracted event date. Photo booth services will not begin until the balance is paid in full. In the case of an event booked less than 16 days out, 100% is due at signing.
The first 50% of payment of the above stated price will be debited immediately. The second 50% payment will be automatically debited 15 days prior to the specified event date, unless otherwise requested by Customer. In the case of an event booked less than 16 days out, 100% of the above stated price will be immediately debited.
